How your Redundancy Package can Affect your Benefits

When you're made redundant, you may have to live on benefits for a while. So how does your redundancy package affect your eligibility?

Voluntary Redundancy and Benefits Entitlement

If you leave your job voluntarily, unemployment benefits are normally not payable (for six months). People who are made redundant should not be affected by this. However, people sometimes wonder how accepting voluntary redundancy affects their eligibility for benefits. It does not. The resulting unemployment is still considered involuntary and those affected should be able to receive Jobseeker's Allowance without any problems.

Occasionally, however, people have been known to encounter some difficulties in relation to this question because of poorly-informed clerical staff at the Jobcentre. If it comes to that, you may need to appeal a wrongful decision. In the end, though, you should win. Omitting the word voluntary from the description of why your last job ended is sometimes said to help avoid these kinds of misunderstanding.

Accepting an Alternative Job and Benefits Entitlement

Sometimes your employer will offer you another job as an alternative to making you redundant. If you feel that the new job differs substantially from your old one, and reject it for this reason, your unemployment will still be considered the result of a redundancy and therefore involuntary.

If you're not sure whether the new job is right for you but would like to try it out, you are entitled to do it for a trial period. By statute this should be at least four weeks, although you and your employer can agree to a longer trial period. If, during the trial period, you decide that the new job isn't right for you, and leave, you will still be considered to have been dismissed by reason of redundancy and therefore involuntarily unemployed.

Refusing an Alternative Job and Benefits Entitlement

The only circumstance in which being offered another job by your employer might give rise to difficulties is if there is a disagreement about whether or not the new job is equivalent to the old one. If you say it is not and your employer says it is, it's conceivable that the Jobcentre staff might take the view that your unemployment is voluntary. In this case, your employer would probably also refuse to pay you a redundancy payment. You could appeal the matter to an Employment Tribunal for a final adjudication. Presenting evidence to the Jobcentre staff that the matter is under appeal to an Employment Tribunal should secure your access to benefits pending the judgement.

Redundancy Payments and Benefits

Provided you have two years of continuous service with your employer, you should receive a redundancy payment when you leave. Although statutory redundancy payments tend not to be very high, if you have a more generous contractual arrangement, or if you have been with your employer for a long time, the amount involved may be substantial.

Many state benefits are means tested, although not all. Unless you immediately spend your redundancy lump sum, for example by paying down debt you have, for the purposes of means assessment, it will count as savings. Large savings may reduce the amount of benefit you get or even mean that you won't get any. This subject is explored more fully in a separate article so will not be dealt with further here.

I've taken voluntary redundancy and will be finishing work on 31st January 2025. However, I also will be receiving my redundancy payment of around £20,800 on 14th February 2025. Would that amount affect whether I get anything from New Style Jobseekers Allowance? It's been about 8 years since I last applied for any state benefits and this is my first experience of taking redundancy so I'm a little confused.

Hello I’ve been made redundant 13th Nov . No notice gjven and no offer of redundancy payment from employer Company went insolvent on December 1st and got rid of all staff I contacted acas and have gone through Insolvency service . Today I had a letter regarding loss of notice compensation ( payment in lieu of notice ) In the letter it states that I will be deducted monies that I could have claimed in benefits that I was entitled to - problem is I haven’t claimed any kind of Benefit! This seems to me I’m paying something back that I never had in the first place ! Can someone give me some advice please ? Thankyou

I'm so confused. I started claiming universal credits 3 months ago, I have now been made redundant and I'm getting government redundancy due to the company going about it this way. I am getting £1280. My universal coach said it will be deducted from my wage, but online it reads under £6000 shouldn't be deducted? I know the coaches don't deal with the pay so was just wondering what was right and what wasn't?

Hi you can only claim job seekers allowance for 6 months . When you get your 12 weeks notice from insolvency they deduct 12 weeks job seekers which you have had from JSA . So if job seekers runs out 6 months from your finish date you In theory only get 3 months is this correct. As you have given 3 months back .

I was made redundant on 30th Sept 2020. I claimed my redundancy via RPS and also JSA on the 5th Oct. As I have worked for the insolvent company for 26 years I am also entitled to 12 week lieu of notice period. Following my call to the Department of Work and Pensions regarding my JSA claim they have stated I should be available attend an interview immediately, and available to to start work after the end of my notice period. This does not make much sense as I have 12 week notice period, and most employers looking to recruit are not going to wait this long - Can you clarify this please. I have also been given a permitted period from 5/10/20 - 03/01/21 to find a job in the same field. The JSA payments will be deducted from my lieu of notice period so in essence they are taking this money back. I have been through a very traumatic time during the last 10 months and would like to take back step without having harassing calls from the DWP. I would appreciate your advice. Regards Rachel

Iv been on universal credit top with furloughed pay I'm being made redundant my last wage will have approx 3 weeks holiday pay plus 2 years redundancy pay approx £1400 will this high wage effect going onto full universal credit will it be added on as pay or will it all work out the month after

hi I was wondering if anyone could help us please. 4 years ago we started to claim tax credits to help paying for my sons nursery costs (£860/month) We used to receive around £400/month if I remember correctly. Unfortunately after 2 years from starting to receive it I was made redundant, and I received approx £1000 redundancy payment which I turned into education so that I wouldn`t have a gap between jobs. Later on we got a letter saying that our income was higher than what we told ( due to the redundancy pay) so we have to pay back all the money we received. I explained the situation to HMRC but they don`t seem to care to hear me. Could anyone advise please if there`s anything I could try to do before I take a loan to pay this money back? Under the 'deprivation of capital rule', a claimant who deprives him or herself of capital for the purpose of retaining or obtaining entitlement to means-tested benefits (i.e. Income Support, Housing and Council Benefit, income-based Jobseeker's Allowance, income-based Employment and Support Allowance and State Pension Credit) will be treated as depriving themselves of capital. Under the regulations the claimant will then be treated as still possessing the value of the actual capital given away as "notional capital" for benefit purposes. However, if you receive a redundancy payment and wish to claim Jobseekers Allowance because you are looking for another job, then your redundancy payment would not affect your ability to claim this benefit.

I currently work 27.75 hours. My employer has informed me that from January my hours will be cut to 25.p.w. This means a drop in pay as I will loose 15 hours per month pay which I cannot afford to loose. I have also been offered severance pay as I am 62. I would like to understand the actual impact of the redundancy payment I'm likely to receive in terms of tax. I do understand the % rules (no tax on the first 30k etc), but I'd specifically like to understand the impact on my tax if I'm fortunate enough to see continuation of employment elsewhere. My maternity leave was due to start next week and I have been told I'm being made redundant and have no job to go back to, I was offered just over £6,000 as Smp pay out which I could recieve strait away or have it in monthly payments.This would end in November(last payment made in November), if I was to take the pay out in one lump sum and was to spend it with in 2 months on stuff I need for baby and other certain bits I desperately need would I be entitled to benifits when it's all gone? It is highly unlikely. If you are using your redundancy money to clear debts, then this is considered a deprivation of capital. You would need to be able to show that you had not disposed of your redundancy money to allow you to claim Housing Benefit (even if it was for one month). The Housing Benefit office will have expected you to have kept money back to pay your rent before you settled your debts. Therefore, this would mean you would not be entitled to claim.

I am being made redundant, my last day will be the 27th January but I have already received my final pay from my employer (paid on the 15th of the month to cover salary until my final day). I am due to receive a redundancy payment on the 15th February, but this money will be spent on clearing debt straight away and I am assuming this isn't classed as income. Hi, my maternity leave was started in Dec 2015 and suppose to end in September 2016, but in Jan/Feb company was planning to close their site where i was employed and they made me redundant in May. almost end of march I applied for housing benefit and they made me redundant in May and paid lump sum maternity in May which i suppose to get till september, My question is the benefit department gave me the housing benefit till 2nd May not till september, Is it fair that i was made redundant while i was on maternity and also am i suppose to get benefit till may only or should get till september?

My company has called in administrators due to insolvency, I have not been paid for 10 weeks which means I can claim max 8 weeks from NI - due to long service and salary I will also be entitled to the maximum statutory redundancy pay. I have been told that JSA will be deducted for 3 months out of my SRP whether I claim or not and even if I manage to find new employment . Please explain and advise if this is correct, I can find nothing about this on the web.

I currently work for a retailer who is in administration but will go into liquidation. I have been told that I will have to claim my redundancy from the government when the time comes. We have recently had some advice from the job centre which has left us somewhat confused. We have been told we must apply for jobseekers on the first day of unemployment. We have been told that any jobseekers claimed between the first day of unemployment and the day we receive our redundancy will be deducted from the redundancy payment. Is this correct? Also that you cannot claim jobseekers while you have your redundancy payment? If anyone could help with this it would be much appreciated.

If you wish to look for another job, then you can claim JSA as Jobseekers Allowance up to the cut-off point which is State Pension Age. JSA has the main emphasis on getting people back into work. Please also see CAB link here which will explain more about what you are entitled to for your age.

Much depends on what benefit you applied for. If you applied for Jobseekers Allowance then if you are up to date with your National Insurance payments (previous two years) then you would be entitled to claim regardless of how much you received in redundancy. However, if you were claiming another benefit, then your redundancy payment may have affected the decision.

In 2006 I was made redundant and applied to my local job center in Kettering,after filling in the required forms I was told that I would be contacted within 2 weeks.After 4 weeks I had not heard anything,so I went back to the job center to find out what was going on.After the job center made had a telephone conversation with the Wellingborough Office I was told.They have new people working in the Wellingborough office and the said that the way benefits had been paid out in the past was all wrong and that because of the amount of redundancy I had been paid I would not be entitled to any benefit until December 2008. I was redundant on the 28th August,2015 by a Mining company due to global economy crisis. The company had carried out mas redundancy exercise in order to carry out cost cutting measures.I have only worked for 2 years and 10 months when the redundancy was introduced but in my Employment contract I will be given a housing advance package of $100,000.00 after 3 years of service and I was only 2 months before I clock 3 years of service. Hi, I have been offered voluntary redundancy 5 months into my maternity leave. I accepted as my work wouldn't let me work nursery hours and my wage would cover nursery fees for two children under 3. Redundancy payments are treated as capital for means-tested benefits. You can see via the Turn2Us link here what are classed as means tested. If you receive any of the benefits listed on top of your ESA and PIP you would have to declare your redundancy payment.

If you earn between the Lower Earning Limit and the Primary Threshold you will be awarded National Insurance ‘credits’ which entitle you to basic National Insurance benefits.. These limits are respectively £112 and £155 per week for 2016/17 (and 2015/16). You would need to find out from your local Jobcentre Plus whether you have been credited for these and if so what benefits this entitles you to.

Hi I was made redundant after 21 years continuous service after the organisation I worked for, closed in December 2016. I worked 14 hours a week and was paid £122 a week. I was surprised I was not able to claim JSA, as they said I had not made enough NI contributions in the previous 2 years. It is true I did not earn enough to pay NI contributions, but when I checked on my NI record, it said my contributions were paid in full, right back to 1982, and I have the full 35 qualifying years towards my pension. I read somewhere that if you earn between £109 and £150, your NI contribution is paid to protect your pension and benefit rights. Why can't I get JSA then? I'm confused!

I have been made redundant. My pay out will be slightly north of 30k. As this then puts me well over 16k savings I presume I will not be entitled to any benefits. But will my wifes ESA be affected as she is signed off due to mental health problems. Really concerned that little bit she puts in to the house will go and really set her back in her recovery. Cheers

Hi, I'm getting made redundant and our enhanced terms say we get 3 weeks pensionable weeks salary for every year we have served. Our salary includes overtime and other enhancement that are not pensionable. Should all our salary (average over 12 weeks)be calculated as we work shifts. Also there is a caviate that after 57 the redundancy reduces by 1/36th every month. Is this superseded by no retirement age now?? Thanks

I was made redundant while pregnant last year. I got full redundancy pay and full statutory maternity pay. I finished working in July 15 had my baby in August. My husband is in the Armed Services and I know with his income I will not be entitled to any out of work benefits however I don't know if I'm still supposed to be having my stamp paid so I don't lose out on state pension payments in later life.

I was offered a package to leave my company for 17500.00 after 7 years. I accepted this package voluntary redundancy. No offer of alternative employment has the company winding down. Can I get any benefits now. I would like to point out I wouldn't of put in for redundancy if I wasn't moved to the team . There was a big move around and I feel they where trying to push me out.

Ive been a tax payer for 33 years, was made redundant at age 48 but as part of my company tax arrangements was allowed to draw my company pension at age 50. I worked for 2 years but have been unable to find work for a few months so wanted to claim Job Seekers Allowance (contributions based), to my disgust I discovered that they take into account part time earnings (I have none) and my very small pension (£520 a month) and have assessed me as not eligible for any benefit at all (my wife earns £800 a month). Just to give you a flavour of how upsetting this is when you look at families on the dole for ever with a thousand screaming kids, I have paid in 30 years I would guess somewhere near £0.5million pounds and I can get nothing, zero, zilch, not a bean back out.

As specified in the article; if you leave your job voluntarily, unemployment benefits are normally not payable (for six months). People who are made redundant should not be affected by this. However, people sometimes wonder how accepting voluntary redundancy affects their eligibility for benefits. It does not. @Yaskett - I have included a link to our partner article: Overview of Your Employer's Obligations, here which shows how the process may be a lot more convoluted than first anticipated and can take time. One aspect may be that your employer might offer you ‘suitable alternative employment’ within your organisation, which may confuse your issue. I presume the job offer you have received will mean you will have to make a decision imminently. Some employers may stipulate in your contract that you wait for a specific amount of time before you take up new employment. Therefore, I would read your contract and see what it specifies. There is no real answer here, as I assume much is about timing. Of course it would be ideal if you were offered redundancy and the job offer could fall in naturally after your redundancy package was finalised and you had served your notice. However, this is in an ideal world and you may find that the timing may force you to make a decision to either move before redundancy is offered, or wait and see whether you are offered a package to suit.

Hi, I'm due to start my maternity leave at the end of august with my second child, but we have just been informed that our jobs are no longer required so will be made redundant after 7 years service. My Husband is a full time mature student who also works part time. Due to all these factors I can't find any acurate information online on what (if anything) we would be entittled to. We currenlty don't claim any form of benefit at all, no working tax credits or anything. The only thing we receive from the government is standard child benefit for our first child. My employer paid 40 weeks stat mat pay which has now just finished. my husband also worked in the same office so was also made redundant but has since found another job. My partner was made redundant yesterday with no warning, the place where he works paid off 400 people. Today he managed to get a temp job being self employed, he made 25k last year and I made 10k, I due to go on mat leave at the end of May as I'm due our baby in July. Your redundancy may be treated as capitol (if including your personal savings the total comes to over £6000). If you lose your job, you might be entitled to more Child Tax Credit. However, you will have to inform both HM Revenue and Customs and the Housing Benefit about the change in your circumstances, which will also give you the chance to get an accurate assessment.

Hi, I'm facing the prospect of redundancy from my current employer but will be (hopefully) be in work with another company by the time the redundancy comes into effect. For the purpose of housing benefit and child tax credit, would my redundancy package be counted as income for this tax year? It will be less than 3k and the new job would be a similar salary as my current one. Thanks

Hi My last working day due to redundancy is at the end of May 2015. Am I able to start the ball rolling with jobseekers, housing benefits etc before this date? For example can I fill in the forms and make an appointment at the jobcentre before the end of May? I just don't want to go very long without anything else being in place. @sandy - If you have more than £6,000, which includes savings and other income, it can affect the amount of contribution-based JSA you get.

@bubbles - yes, you can claim Jobseekers Allowance as long as you don't have any other income which includes money from pensions, earnings and savings of more than £6,000. I hope this helps.

I am due to take redundancy next month. My firm has relocated and had to offer redundancy although they say it is voluntary. I have worked there for four years and will receive £1400, statuary redundancy pay. Will I be able to claim contribution based benefit straight away?

@Paris - it depends on what benefits you will need and whether you will be looking for another job. You may be able to claim Jobseekers allowance, but there are limitations on the amount of savings you can have, as explained in the article. It is quite possible I am going to be made redundant, will I still be able to claim benefits I am a women 60 years of age and not due to retire until I am 66 I have been offered severence if I take severence what benefits will I be entitled to. @Billy - you can claim Jobseekers allowance if you are up to date with your National Insurance and have been paying it for a period of time prior to being laid off, There’s no time limit for how long the period of consultation should be, prior to you being made redundant. However, there is a scale regarding the amount of redundancies taking place. If there are 20 - 99 redundancies - the consultation must start at least 30 days before dismissal, or if there are 100 or more redundancies - the consultation must start at least 45 days prior to dismissals. @Monstasquirrel - If the company you were working for is paying the redundancy, then it should be paid on the last day that you work or as soon as is possible afterwards. If there is to be any long delay with the payment, then it needs to be discussed and agreed with you the employee. I hope this helps.

@ big al. I'm very sorry to hear of your redundancy after all of this time. You should get a letter from your HR laying out your terms of redundancy including any redundancy pay which should be awarded to you through the company. As soon as you leave you should sign on for Jobseekers Allowance (if you are up to date with your National Insurance contributions, which I'm sure you are). You will receive £72.40 per week for a period of six months while looking for a new job. You can apply online, or telephone 0800 055 6688 (open 8am-6pm Monday to Friday). They will bring you in for an appointment and are very helpful should you need extra advice on looking for your next job. Your National Insurance is taken care of while you are receiving the allowance. Wishing you best of luck for the future.

I am 56 years old woman, have been in my job for 10 years and still working, but I have long been suffering of depression and taking medication for many years. I was off and on with the idea of leaving my work due to the constant tension which affect my physical and mental condition. My GP is aware of this all, and I get some good support from her. Now, I am thinking to leave the work by the end of this year, but has so much doubt about how I can manage my finance. I believe I would get a sum of money as redundancy package. I have an idea that my employer will pay me one month salary for every year in service, taxable. I also have some saving in the bank, but not much. I received a compulsory redundancy payment, gross £48k at Christmas and luckily I've found a new job. However, this will bring my gross pay over the £50,000 income tax bracket. I receive Child Benefit for our children, will I have to do a tax return or is the redundancy discounted?

I took Voluntary redundancy on 30th June and was paid c £29k after stoppages. I am 3.5 years into an IVA agreement and under the agreement was only allowed to keep 6 months money and paid over £16k to my creditors.( I still have to pay the monthly payment out of the 6 months I kept). I have not claimed any benefits since I took redundancy. Would I be entitled to claim anything as the money will run out next month and although searching for a new job, have not secured a new job yet. I have been in continuous employment since I left School 39 years ago. If I am entitled to any benefits, would it be backdated to 1st July please?

I have been made redundant just end of last August after more 5 years working for publishing market. I applied for Job seekers by online in 5th of Sep, as they said- I have not any knowledge yet- and received a letter that I am not include of backdated claim from 30th of August. The amount money the law accounted for each week is £112.55this amount is just covered for just for adults living expenses,my wife and me , it does not mentioned any for the children , as I have a son 11 years.I would be grateful if let us know the decision made for my family is right and whether there is no point for children in my current allowance.

My employer gave notice of redundancies last thursday and told us that they would send us a letter about this straight away (it arrived this morning when I was at work).They also produced a form this morning asking wether anyone would like to volunteer for redundancy which was a simple yes/no form.I asked my line manager if it were possible to know how much my redundancy package would be if I did volunteer and was accepted.I was refused this and the reason given was that knowing the figure may influence my decision when answering yes or no and that if my company gave me that information they could be seen as encouraging me to make my decision one way or another.I TUPIED over to the company I work for now and my present company have confirmed verbally that my reckonable service amounts to just over 18 years but they will not confirm this in writing.??????any advice would be welcome
